About the Deed of Gift

The Deed of Gift is the document which gives the library the rights to display your items in the Digital History Collection. It has 4 primary sections:

About the Item: This is just background about the item itself. In order for us to know what to say about the item and for users to find it as beneficial as possible, we need to have your input on what it is, where it came from, when it was created, etc.

Transfer of Rights: This simply gives us permission to display it in the collection.

De-accessioning and Disposition: It’s not as likely with digital items, but there’s the opportunity that we need to remove items from the collection – we find out there’s personal information that is protected, someone copyrights parts of the documents, etc. This just handles how we look at decommissioning items.

Transfer of Intellectual Property Rights:

Donor warrants that it is the lawful owner of the Donated Materials and transfers such interests in the Donated Materials to Donee as described below (Select One):
Intellectual Property
- Full Assignment of Copyright: The Donor freely assigns its copyright in all digital representations of the Donated Materials to Donee.
- Irrevocable License: The Donor grants Donee a perpetual, irrevocable, unlimited license to use and distribute all digital representations of the Donated Materials. Donee warrants that Donor will be acknowledged in the future use of this material where required by law.
Disposition of Donated Materials:
If Donee chooses, for any reason, not to accept or retain the Donated Materials, they will be disposed of as follows (Select One):(Required)
- Disposal: The Donor grants the Donee the right to dispose of any portion of the Donated Materials not retained by the Library Collections and Archives in whatever manner deemed appropriate by Donee.
- Return to Donor: Donee will return any digital files not retained in the Library Collections and Archives to the source’s Donor. If the Donor cannot be reached after three attempts have been made, the Donee will dispose of any unwanted material as they see fit.
Deaccessioning:

The Donee may transfer contents of the collection to a more durable or compact medium for preservation or other purposes, or otherwise deaccession the original collection materials in accordance with the Donee’s policies and procedures.
